· You agree to defend, indemnify and hold harmless www.bujju.com and the Company, its employees, directors, officers, agents and their successors and assigns and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfilment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this Agreement.
· In no event shall we be liable to you, the vendor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not we have been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of or access to the website, services or materials.

15. Shipping Information
a. Time taken to ship the product
Once the order(s) has been placed by a user and accepted by Bujju, and payment has been made, the product will be shipped within twenty four to forty eight (24 - 48) working hours based on the product availability. If the product is in stock currently, it can be redesigned or reproduced. The time to redesign and posting will be discussed directly with you. However, in most cases all such items not currently available will be posted within seven to ten (7-10) working days’ time.
b. Time taken for delivery
Usually all the items will be delivered within three to four (3-4) working days in some rare cases it takes five to six (5-6) working days or more for any remote places. But the tracking is available till the item reaches the destination.
c. Mode of delivery
All products will be shipped through DTDC courier service all over India and other local services are used for orders to be delivered to the United States. Every item is sent with secure packing and tracking number is provided for every order and can be traceable till it reaches the destination.
d. Shipping areas
We ship to all major cities in India and everywhere within the states of Andhra Pradesh, Telangana and Karnataka.
e. Shipping Charges
You agree to bear all shipping charges and the amount will be intimated to you at the time of placing the order and making the payment. We will provide discounts on the shipping charges wherever possible, based on the quantity and price of the products purchased.

19. Dispute resolution and jurisdiction
The formation, interpretation and performance of this Agreement and any disputes arising out of it will be resolved through a two-step Alternate Dispute Resolution mechanism.
a. Stage 1: Mediation. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party and will be selected at the mutual acceptance of a proposed mediator by both parties. Both parties may raise a name for sole arbitrator and in the case both parties accept the proposed name, the said person shall be appointed sole mediator. In the case the parties are not able to reach a consensus within two proposed mediators, the Company reserves the right to decide who the final mediator is. The decision of the mediator is not binding on both parties. However, the parties in good faith will attempt to bind by the decision.
b. Stage 2: Arbitration. In the case that mediation does not yield a result suitable or preferred by any one of the parties, arbitration may follow, the award of which is binding on both parties. The Arbitration Board is to comprise three members. One is to be appointed by each party and the third member is to be nominated by the two appointed members by mutual consent between them. The award as the outcome of the arbitration is final and binding on both parties and there shall be no further remedy available to both parties. The arbitration proceedings will take place in the English Language and will be situated in Bangalore, Karnataka. The mode of appointment of the arbitrators is as provided above.
In the event of the dispute resolution mechanism failing, the matter shall be governed by the law, rules and regulations of Bangalore, Karnataka. The exclusive jurisdiction and venue for actions and disputes mentioned above shall be the courts located in, India and you hereby submit to the personal jurisdiction of such courts.
20. Miscellaneous Provisions
(a) Entire Agreement: This Agreement is the complete and exclusive statement of the agreements between you and us with respect to the subject matter hereof and supersedes all other communications or representations or agreements (whether oral, written or otherwise) relating thereto.
(b) Waiver: The failure of either party at any time to require performance of any provision of this Agreement in no manner shall affect such party's right at a later time to enforce the same. No waiver by either party of any breach of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any other such breach, or a waiver of any other breach of this Agreement.
(c) Severability: If any provision of this Agreement shall to any extent be held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement shall in no way be affected or impaired thereby and each such provision of this Agreement shall be valid and enforceable to the fullest extent permitted by law. In such case, this Agreement shall be reformed to the minimum extent necessary to correct any invalidity, illegality or unenforceability, while preserving to the maximum extent the rights and commercial expectations of the parties hereto, as expressed herein.
21. Return Policy for Products

1.2 Upon receiving Your complaint, Bujju shall verify the authenticity and the nature of the complaint and if Bujju is convinced that the complaint is genuine, Bujju will inform the relevant Vendor of such complaint and request for a replacement. However, in the event of frivolous and baseless complaints regarding the quality and content of the products, Bujju reserves the right to take necessary legal actions against You and You will be solely liable for all costs incurred by Bujju in this regard. You expressly acknowledge that the Vendor selling the defective product/ service will be solely responsible to You for any claims that You may have in relation to such defective product/ service and Bujju shall not in any manner be held liable for the same.
1.3 Before accepting shipment of any product, kindly ensure that the product's packaging is not damaged or tampered. If You observe that the package is damaged or tampered, request You to refuse to accept delivery and inform Bujju at the earliest. The return process of the product may be restricted by Bujju depending on the nature and category of the product.
1.4 In order to return any products sold through the Website, You are required to comply with the below mentioned conditions.
1. Please notify Bujju of receipt of a damaged/ defective product/service within 48-hours of delivery to You. If You are unable to do so within 48-hours, Bujju shall not be held liable for the failure to replace the order.
2. Products should be unused.
3. Bujju will arrange pick-up of the damaged/defective product through its own logistics partner. In the event Bujju is unable to do so, Bujju will notify You regarding the same and You will be required to dispatch the product using a reputed courier in Your respective area within one (1) day from receipt of such notice. Courier freight charges will be reimbursed into “Bujju Wallet”.
4. Products should be returned in their original packaging along with the original price tags, labels, barcodes, user manual, warranty card and invoices etc.
5. It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of products during transit.
6. The returned products are subject to verification and checks by Bujju in order to determine the legitimacy of the complaint/ return.
7. Bujju is not liable to pay the return shipment charges for product Exchange and if there isn’t any mistake from our end.
1.5 In the event the return of a product is duly accepted by Bujju , the value of such product, as originally paid by You during acceptance of delivery of product or otherwise, will be refunded to You. Refund will be processed based on the mode of payment and Bujju or the approved payment gateway will credit Your refunds directly into Your debit/credit card or online accounts or provide You with a cheque in this regard. Refunds will be subject to the following:
1. Orders paid online will be refunded within 7-21 working days through the online account or via cheque, depending on the then current circumstances as determined by Bujju;
2. For Cash on Delivery payments, You will be provided with a refund cheque or direct bank transfer.
3. If the product can be repaired by the service center, Bujju would get the same repaired and send it back to You.
4. A promo code, once used shall not be refunded in case of cancellation of order either by customer or Bujju.
2.1 Cancellation by Bujju: There may be certain orders that Bujju is unable to accept and must cancel. Bujju reserves the right, at Bujju's sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in Your order being cancelled include, without limitation, non-availability of the product or quantities ordered by You, non- availability of the service, inaccuracies or errors in pricing information, or problems identified by Bujju's credit and fraud avoidance department. Bujju may also require additional verifications or information before accepting any order. Bujju will contact You if all or any portion of Your order is cancelled or if additional information is required to accept Your order. If Your order is cancelled after Your credit card has been charged, the said amount will be reversed back in Your credit card accou
